These terms apply to every order for Obsidian Oil products placed with us by a business customer. Obsidian Oil products are distributed by Moore Lubricants, which accepts and fulfils orders. By placing an order you accept these terms. They do not affect any statutory rights that cannot be excluded.
1. Orders and quotations
Quotations are valid for 30 days unless stated otherwise and are subject to stock availability. An order is accepted when we confirm it in writing or dispatch the goods, whichever happens first.
2. Prices and payment
Prices are in pounds sterling and exclude VAT and delivery unless stated. New accounts pay in advance (pro-forma). Approved credit accounts pay within the terms agreed in writing, normally 30 days from the end of the month of invoice. We may charge interest on overdue sums under the Late Payment of Commercial Debts (Interest) Act 1998 and suspend deliveries while an account is overdue.
3. Delivery and risk
Delivery dates are estimates. Risk passes to you on delivery. Please check goods on arrival and note any damage on the delivery note, then tell us within 48 hours as described on our delivery and returns page.
4. Ownership
Ownership of the goods remains with us until we have received payment in full. Until then you must store the goods so they can be identified as ours.
5. Product use
You are responsible for selecting the correct grade for each vehicle. Product information, the oil finder and technical data sheets are guidance only; always confirm the grade and specification against the vehicle manufacturer's handbook or service data before use.
6. Quality and liability
Goods will conform to their published specification when delivered. If goods are defective, we will replace them or refund the price at our option. Our total liability for any order is limited to the price of that order, and we are not liable for indirect or consequential loss, loss of profit or loss of business. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.
7. General
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. Questions about these terms: sales@moorelubricants.co.uk.
